"Regulatory Sandbox" Law and economics y el test de "Good Regulation"

Abstract

La disrupción tecnológica producida por las entidades Fintech dentro del sector financiero crea la necesidad de que el regulador de dicho sector deba adoptar una posición. El “Regulatory Sandbox” emerge como una potencial respuesta para estos nuevos desafíos generados por dicha disrupción. El presente trabajo presenta un estudio sobre la historia, concepto, legitimidad y calidad del instrumento. Conceptos propios de Law and Economics dotarán de contenido al término “legtimidad” utilizado a lo largo de la presente tesis. Pero, ¿cómo se sabe si el Regulatory Sandbox es el camino correcto para resolver tales desafíos? Para dar respuesta a este interrogante se introducirán conceptos propios de “good regulation” y se analizarán aquellos criterios para determinar el valor de una norma. El Sandbox, ¿es good regulation? Responder este interrogante será el objetivo del presente trabajo.The technological disruption caused by Fintech entities within the financial sector creates the need for the regulator of that sector to adopt a position. The "Regulatory Sandbox" emerges as a potential response to these new challenges generated by such disruption. This paper presents a study on the history, concept, legitimacy and quality of the instrument. Concepts proper to Law and Economics will provide content to the term "legitimacy" used throughout this thesis. But how do you know if the Regulatory Sandbox is the right way to solve such challenges? To answer this question, concepts of “good regulation” will be introduced and those criteria to determine the value of a standard will be analyzed. Is the Sandbox good regulation? Answering this question will be the objective of this paper.
